Margaret- I do have people who can help in this field, I work in real estate, but this is something that is goin to probally have to be handled legally. Especially with the mold issue, its just out of hand, our entire basement is just so damp, its nasty. I have tried a few different things... hopefully something will work out for us

towards what to do! I think you are going to have to get a lawyer in your state and get tough with your builder as the ramifications of this are pretty serious. Do either one of you have parents or friends that you can talk this over with, too, who know about this kind of stuff? I am not in this field at all.

Well our contract says we where supposed to get a perimiter drainage system around the house, but they never installed it... thats where we stand now We are tryin to see what our options are.

This whole situation sounds serious. I think I would take him to court. I wonder if the drainage on your house was never done correctly. Please email Gary and get some advice from him. This could affect the overall foundation of your house and your selling price in the future. You may end up having a lot of problems. Good luck!

second ..okay sweet girl...don't stress over what will eventually all work out..it sounds like the legal end of your contract with the builder is on your side..so yes I know it is one big hassle and frustration....but all you can do is plod through it...till it's all over ..and fixed..and it will be ...ya just gotta jump through the hoops...
but and this is my point and the most important part...don't let it for one minute stress you out...stress steals our minutes ..our seconds..and we can so easily miss the joy and little daily gifts when we are stressing...call who you need to call...do the paper work that may need doing..but inbetween the times you are actively getting it all taken care of...let it all go ...and claim the in between minutes for your own ...life is so full of those fortuna pesty poke a finger in your eye times...
you just have to keep them in their place ..and not let it over flow into the good stuffs...smile...

I dont think perimiter drains are required here, I think they figured because our basement was built out of the ground they could get away with it.

We contacted the state weeks ago and they said our situation is covered and the builder has to cover it, and if they dont then to file something with them.

Originally when we argued this, my husband called them and talked to one of the owners, and he said you never installed the perimiter drain that says in our contract we where supposed to get and the builder said ok well we will put that in, and my husbadn said well if you do that you will reconstruct our decks and you will also put all new landscaping in again which will total over 8,000.00 alone. These peopel are just stupid, but I'm so pissed off.

We do have a 1 year warrenty on the basement thats gurarenteed, I shoudlnt have gotten so worked up but I couldnt help it..

Did you just build your house? You should have a 1yr. coverage on your house by the builder. Some things have even a longer warrenty. If it's in writing they can't say no. If they didn't put in proper drainage around the house how did they ever pass building inpection? They'd be dumb to give you a hard time for you have a good case against them. Just keep your chin up there's always light at the end of the tunnel.
