Question- Are any of you lawyers? Or do you have law experience?

This is waaaaaaaaaay off topic, I posted a message a few weeks ago about a problem I was having in my basement, and since then, theres BAD mold spreading on our sheetrock in the basement, and we have had a waterproofing company come in and they have estimated the damage and have said we MUST get a drainage system that will keep the water out, this is going to cost 8k-10k and our builder, finally has agreed to pay for it and has claimed they are going to send it to their insurance company.

So heres my question, they have told us to get additional estimates and they are having an insurance adjuster come out to assess our damage, do you feel it necessary we need a lawyer at this point, or does it sound like everything is going as it should.

We dont really have the money to put out if we dont need a lawyer a this point, but if it would help us, I would look into it. I just need advice.

The house is 7 months old, and the builder is obligated to fix our problem up to 1 year. Thanks

I am also not a lawyer, but I am a Realtor. I don't sell much new housing, however it sounds like your builder is doing the right thing.

When dealing with this situation, write down everythign, including phone calls, what people tell you, who you talked to and when (time and date), just in case. If they promise to fix it, make sure you have a date by which they promise to finish the work satisfactorly.

Just our of curiosity, did you use that synthetic stucco on the outside of the house? It looks like stucco but can come in colors.

I called the builder with the estimate we had gotten so they knew what price they where looking at, the girl who handles all their work said they where expecting it to be over 15k and that it was a good price, she proceeded to tell me to get them the estimate in writing and wanted to know if we wanted to schedule them to come out and do the work. At this point I was actually kind of shocked it was so easy. HAH! Guess i was right, today I got a message that they didnt want to sign anything until their insurance adjuster came out to assess the damage to our basement and they wanted me to get more estimates. I'm getting worried because the mold is spreading and its about 4 feet up our wall now in the basement and I dont want it getting into the house, we have already told them to replace the sheetrock ... I just don't want to get stuck with nothing ... specially since our 12 month period is coming to an end in a few months, but I guess if they said they will pay for it they will, but they have to have their insurance adjuster come out first, and I dont want that being a LONG process...

Not a lawyer but.....

I just took a class on Mold and was told that you want to make sure they remove all the sheetrock that is damaged and at least 2-4 feet past any mold marks.

Don't just let them waterproof over it. The mold will not go away like that.

I'm a lawyer. I agree with net, and don't see any reason that you need a lawyer at this point. It seems as though the builder is cooperating, especially being that they are sending out an insurance adjuster. I would just be sure to document everything...get the builder to put it in writing, or the very least, send them a letter confirming your conversation regarding their agreement to pay. I'm not a lawyer, but have had new home experience. As long as the builder fixes it to your satisfaction within a reasonable amount of time, I don't see why you should pay the expense of retaining an attorney. We had all sorts of things go wrong with the home, little things, unexpected things, but the builder came through and fixed them all. Sometimes it took a few phone calls, but the point is, the work got done, no lawyers involved.
