....who has been told repeatedly NOT to come into my yard and tease my dog, am I liable?
God forbid this happen but I've had it with the kids next door thinking my house is also a playground. I know I should go over and meet/talk to the parents but it's not just the one kid, it's a group of four or five pre-teen boys who want to ride their skateboards in my driveway and it annoys the heck out of Newman and me.
I am not in a mood for this today and just wonder if Newman did hurt one of these little s#!*s who seem not to understand "don't come in my yard and aggrivate him" am I on the hook for anything?
Man, I sound mean.
That's just wrong
that it's OK for the neighborhood sh**s to be abel to tease your dog on YOUR own property and if something happens you are liable. Irritates me! Just one of the reasons I don't like kids and parents.
It's funny, this just came up with us...
Our insurance agent wanted to get together to do an insurance "check-up", to make sure we had the right coverages---he inherited our account when our old agent moved to another state.....so as he is going over everything he gets to our personal injury liability and it's $500,000 and he says "if you had a pool or a trampoline you would want to increase that" and we told him that we have both....he made us go up to $1,000,000....he said it doesn't matter if people are invited or they trespass...if we are not home and a group of teenagers decide to play in our pool and oen drowns, we would be liable....Kel asked about Cooper biting someone or hurting someone elses pet and he said we would be liable. He said we could go to court and show we had "no trespassing" signs and fences and we might win some sympathy from the jury, but in reality we would probably still lose.
Yes, I do believe you'd be liable.
A dog bite is a dog bite...on or off your property.
Simply call the police to come & ask them to leave and theaten that they'll be arrested for tresspassing if they come back.

Back home in TExas.......
I had the same problem with my Rottie. Only this 10 yr. old kid was shooting my Rottie in the face with his high-powered water gun. I took my short fat brown butt right next door, told the lady "Look he's a Rottie" and if you're son continues to "Tease" my dog, I am not liable or responsbile for any injuries incurred by my dogs teeth. With that being said let them know that since you spoken out verbally that a verbal agreement is a binding contract in the state that you live in, that'll let her know to talk to the punk pre-teens that are bothering your poor baby.
Now behave
!
Auntie Deb, you're not mean you're a lover
throw some small pebbles or gravel in the driveway. The skateboarders hate this because it makes them trip off their boards. Once they see the gravel they'll go to someone else's driveway... unless they sweep yours but highly doubt that's going to happen.
Otherwise, you really have no choice but to speak with the parents.
TASERS!!!! yes...thats what im going to use on my husband
on the nights he wont leave me alone...if u know what i mean...lol
I agree...your not mean at all!!!
I'd be pissed too. i agree that filing a complaint would be good to do. but maybe talk with the guardians of the kids first unless the are sh$%'s also ..good luck
I'm not a lawyer, but...
I think you could be in trouble. I think you should first ask the kids to stay out of your driveway (be polite, 'cause you don't want retaliation). If they mouth off or don't stay off the driveway, talk with their parents. Tell the parents that your insurance company is making you do this. If they hurt themselves skateboarding, you could be libel for that too.
Again, this is my understanding. I am not a lawyer or an insurance agent.
Not mean at all girl
It's so frustrating when those little @#$%! don't have any respect for grown ups!
What were they talkin' about last nite? Tasers? I wish!!!
I agree with Rottie...
File a complaint, no matter how much of a pain it is, each time the brats are in your yard or drive. What do these kids think anyway? Geez, I seriously dislike kids that have no respect for other people. Anyway, maybe you should also speak to the parents, gently tell them you WILL pursue a complaint with the police as it continues. They might take the nice hint and make the kids stay away. If they don't, the police should do something, since the kids ARE trespassing on your property.
Hugs to you and Newman!

Idea here
get an underground electric fence and put the collars on the damn kids

Honestly Deb, I don't know but it is your private property so could it be considered trespassing? If yes, then they have no right to be there, epsecially if you tell them to stay out/off.

You don't sound mean!
But unfortunately, the answer to your question is yes. What I would do is file a complaint every time you catch these kids in your drive. That way you have some documentation. My hub had a problem with the neighborhood kids skateboarding in his parking lot (they were destroyimg the planting beds, moving the concrete parking things, etc!). He notified the cops and filed a complaint. Good thing, because one of the kids fell and hurt himself and the mother came to the hub's office to complain! She wanted him to pay the medical bills! The hub said that was fine but that he'd pursue trespassing charges and vandalism charges against her son. SHe left.

Sprinklers
Set up a sprinkler like you're watering the grass, and turn it on every time you see them on the drive. Aim it so it does a little of the grass, but not too much. Get it? They'll dry out, and it won't hurt them.
No Tresspassing signs
If you put them up, the kids, or their parents could be arrested for unlawful entry to property. Big signs, displayed prominently. Just like farmers do against hunters.
