I have friends who had been looking for a puppy for quite some time. They lost their bully about 2 years ago. They found a really pretty puppy bitch. They first saw pictures and a video of her. They then visited the breeder twice and put a deposit on her. They received a dated receipt signed by the breeder describing the puppy, amount of deposit, balance due and day of pick up.
Five days after the transaction the breeder decides that he wants to keep the pup and wants the people to either choose another puppy or get their (non-refundable) deposit back & go elsewhere.
They don't want another pup. They're in love with this one. They've named her, prepared for her arrival, bragged about her to anyone who would listen. They're devastated and don't know where to turn.

I agree with last post if after only 5 days how as the buyer you that emotionally attached to puppy! breeder has been there since day one,explain why you want to keep this puppy, and offer them another puppy, as you said the breeder did, and they still dont want another puppy even at a reduced rate,pup was beeing sold as a pet so it shouldnt be that big of a deal.when my pups are sold all pets are on a spay/neutar contract and all my pet pups are akc papered but restricted as im sure most of the better breeders are, that hasnt even been mentioned.Ive seen many many breeders do this exact same thing but no one talks about it,we all wonder why it is so very hard for new comers to get involved in our breed this is why right here.It was even mentioned in the post that a lawyer was involved.WHY I must ask this would get thrown out in court real fast due to the said puppy is atleast i think if i read post right pup is still on breeders property never left and breeder did everything he could to assist with another pup judge would through this out,again i must say what was the agander here dosnt sound right but again this is why so many new comers to this bulldog breed dont want to stay with us its very sad and shame on us for treeting new comers or anyone like this.Lets all move on talk about nice puppies or upcoming shows LOL

I personally wouldn't take money for a puppy in any way if I wasn't 100% sure, if you take a deposit you've pretty much sold the puppy, if you haven't I think you have a right to change your mind. But I don't see how a buyer is attached to a dog they haven't brought home yet?? The breeder is the one who has cared for the puppy since day one.

Well in general, the breeder holds back all the pups they cant decided on. If I have 5 pups and they are all very close, I hold all five back and wait. As they mature and change, I will then start offering what I dont want to keep. If that pup was offered and changed THAT much in 5 days to warrant wanting to keep that pup, speak to the new owners and explain why it is you want to hold that puppy and what it may be able to offer the breed as a whole....if they aren't biting, you must go forward and place the pup.....if you are not able to keep the pup, another option is to offer to co own the dog if they are willing to show it...put a price drop and let them allow you to take a litter from her in the future. Ethics are far more important than one puppy. If one expects an owner to abide by a contract, the breeder first must be willing to do it.

I held puppies for people to go on vacation, finish school(school teachers) and such and these pups were 12-14 weeks before they went to their new homes. I don't care to hold them until 10 weeks but I am big on socialization and its very difficult to properly socialize 3-4-5 puppies going to petsmart etc....and fortunately everyone come and got their puppies but at any given time they could of backed out and then I have a difficult time placing them and on top of that we had turned away numerous other good homes. I was lucky everyone come got their puppies, the puppies did get socialized, they actually had 3rd set of shots so the new owners were able to pretty much get out with them as they pleased. It can be stressful sometimes not taking deposits.

that now thier is the good ole Internet and shipping of puppies across the states to homes you know very little about.
I think that has driven many to also take deposits as well.
I am with ya..wont ever take a deposit.
I also wonder if many take deposits becasue they financially dont have the money to sustain the breedings? So they take deposits in hops topay off a vet who may have done a c-section on a payment plan or thier chrage card..

...I know. I know. You guys probably get tired of hearing how we old time bulldoggers did things way back when,as we can come off sounding self righteous and all that, but honestly, I do not understand why todays sellers take any kind of a deposit.
When people called wanting a puppy we always had a list of interested buyers and we put them on it in order to their saying they wanted a puppy. So the first name had first rights to refusal,when the next litter was born, followed by second rights to refusal, etc, right down the line. If there were five pups then the first five we notified. Then when it was time for them to pick they did it in that order.They could say they did, or did not want a puppy. Then and only then when they were ready to take the baby home, did we take the payment in full from the new owner.
We gave them a health certificate from our vet and then 24 hours to get another check up by their own vet if they so chose. We agreed that if their vet found something that would have made them not want the pup, then we agreed to give their check back in full, take the pup back and pay their vet bill. NEVER did we have that happen.
Another thing. We never cashed a buyers check until one week after they took the puppy home. We would wait and talk to them then to see that all was well and if so (which it always was) then we would cash it.
To back up a bit, after the pups were born, the people all got to come and visit regularly before we let the pups go at eight weeks and it was interesting how different families all like different pups so we kind of knew who was going to take which pup. Never had any problems.
I think was has entered into today's equation is the flooding of the market. Supply and demand is now reversed. We always had more buyers than pups. Today their are more pups than buyers.
Something similar happened to us as well...
We were in contact with a breeder by phone who had listed her litter on the AKC website. She was within driving distance from us so when the puppies were 5 weeks old she said we could view them with the understanding that she was unsure which "one" she would be keeping so she would not be accepting any deposits until they were at least 6 weeks old. We went to see all eight puppies. There is nothing cuter than a litter of bulldogs climbing all over you! She had a nice clean house with the dam & litter right in the middle of her living room, with her whole family involved in their care, just what we were looking for. The only male was already spoken for by the owners son, which was fine since we were looking for a female. The breeder showed us which females were her favorites. She told us that once she decided which one she was going to keep, we would be first in line to select ours and pay the deposit to hold her since nobody else had seen them yet. We told her our top 3 that we had in mind, it was a very nice litter (I won't mention any names, but had a nice pedigree), and we would have been happy with any of those 3. She said we could come back the following Saturday, when the puppies were 6 weeks old and pay our deposit...that she would know by then which one she was going to keep. I spoke with her almost every day that week and she sent me new pix of all the puppies. We narrowed it down to our top 2 picks, that way if she picked one of them we would just pick the other one. Seemed straight forward, and our whole family was very excited. We kept looking at their pix and thinking of names. We stopped our search since we felt like we had a puppy lined up finally after all the months we were looking. On Wednesday night, the breeder wrote to me and told me which one she decided to keep. I wrote back to her and said we would give her the deposit on Saturday for the other one then that we had liked, since she chose one of our 2 picks. She was agreeable to that. Again we were all very excited. On Friday morning she called me...Someone had come by Thursday night and paid the deposit on the puppy we wanted. When I asked her which puppies were left, she said that she (the breeder) had decided to keep "two", then the owner of the stud dog had picked another one (something she never mentioned before), (her son had kept the only male), and then this other person was ahead of us in choosing (something else she misled us on!) So there were only 3 pure white puppies left, not any of them were the ones we chose (they were adorable and I love pure white also, just not what we were looking for). The breeder said she decided to keep 2 of our original top 3 picks, which was strange since those weren't the ones she was interested in when we visited her the weekend before; she was choosing hers based on personality, she did not plan on showing them. In the end she said she would show both of them! Weird...Anyway, we did not end up buying a puppy from her and I haven't heard anything else from her. It was very unprofessional though and I will never approach a situation like that again. She definitely misled us and our first thought was that she must have been offered more money for them or something. She seemed to like us and I don't believe she thought we wouldn't give her baby a good home. She knew we wanted to show the puppy and she was very excited about that as well since she hoped they would end up in the ring. Who knows what all happened. Oh well, we ended up with a much more professional breeder and are very happy with our girl, Phoenix. (sorry, I guess I was still harboring all that irritation!! Feels good to vent!)

I think if the breeder did not disclose he had any intention of keeping that puppy then he should not be holding this puppy back now. A receipt is a promise for a particular puppy. Breeders should not flip flop on their decisions. As a show breeder I often tell people which ones I am considering and won't take a deposit on them until I am sure. I ask them to make a 1st 2nd and third pick. Sounds like this breeder has a lot to learn about integrety. Lots of websites pull this bait and switch to get poeple's money and send them crappy puppies. Sounds like a puppy mill to me !!
I started taking deposits when
i held puppies until 9 weeks, all puppies spoken for and then they got puppies from someone else. You talk with people until your blue in the face, send pictures, talk on the phone daily, answer all the questions they have, let them in to your house and family and at 9 weeks they stop talking to you and then send you a note they have got apuppy from someone else. Well in the mean time, you have turned away buyers and sent them to other bulldoggers with puppies and now you have helped sell everyone elses puppies and you now have puppies of your own to sell.
I talk to people all the time about puppies, i do not take deposits on puppies who are not ALIVE, to me that is WRONG. I let people come and see the puppies at about 5 weeks, (a few have come earlier) At that time i let them know they will have 2nd, 3rd, 4th pick. I let them know i get 1st and if im looking for a girl or a boy. When i have made my choice to either keep my pick or not, then i let number 2 know they have a choice between the puppies, then let number 3 know and 4. Everyone was happy, they knew they were getting a puppy and boy or girl, i talk in detail how you should not choose color but the best puppy for your family and a healthy puppy. I have not had a problem with this. Well my only problem was number 2 pick wanted a Red girl, so i told everyone that we only had boys, well number 2 came and fell in love with the White Boy. number 3 pick wanted the white boy, i didnt have a white puppy, but my friend did so they got their puppy.
Taking deposits weeds out the lookie loos and people wasting your time.

I saw that on a web site awhile back. Figured they did that to hold out for another buyer to pay more.
I hope those people are able to move on and deal with a reputable breeder.
you never know how a puppy will turn out and it might not be the
for the family. If im not keeping a puppy then i take deposits on first pick 2nd pick, 3rd pick.....
I still keep 1st pick for me, and if i back out then i tell 2nd they can make thier choice......

I tell people up front that 1st pick goes to breeder with either sex and I also tell them which one I am leaning towards keeping so they know upfront that that puppy is spoken for OR I don't even show the puppy(ies) I am keeping to them. I have heard of this happening the breeder changing their mind, I find it in bad taste, but I can't police the world and don't try. If the breeder will give the deposit back, I would take my money and go elsewhere.

if they were promised with signed papers, this dog, then it shoudl be theres, plain and simple... if they are breeching a contract, then its a issue for court.. however, do you really want to take a dog when you have abreeder who is doing this, going back on there promise??? i would move on and tell everyone wholistens about there practice myself!

has first choice of a litter....this should of been told up front....i as a breeder always had first choice....i also temperment tested and some times the puppy some one wanted was not the right temperment for them....but again i told everyone up front my policy
I would go elsewhere
if in 5 days the breeder changed their minds they shouldn't have promised it in the first place and taken a deposit on it. The breeder should go through with their committment unless they found proof of the home to be unsuitable for a bulldog after the deposit was received.
In the chance that they were to go through with it now, I would always be worried about what would and could happen down the road... integrity is important in a breeder and there are plenty of nice puppies out there from people that wont make open ended promises.
Unfortuantly these people are out their time and might have learned a hard lesson about working with a trustworthy breeder. Sure hope they find another nice baby... wish I had a girl for them but we just have boys.
