Palm Beach County officials have taken the bite out of a controversial plan intended to force residents to spay and neuter their pets.

For months, Animal Care and Control Director Dianne Sauve has been pushing a plan that would have made it illegal for residents not to spay and neuter their pets, in an effort to reduce the number unwanted animals killed at the county's shelter each year.

The "mandatory" program originally required all pet owners to sterilize their pets, unless it is a show animal or a guide or service dog. Animals that were found by a licensed veterinarian to be medically unfit to go through sterilization surgery were also exempt.

But the county's newest version of the rules would allow all pet owners to opt out of the requirement by paying a $75 fee. Pet owners who purchase the unaltered license would also be required to certify in writing that the dog or cat will not be bred.

County commissioners will consider the proposed ordinance Tuesday.

For the past few weeks I have been in contact with
Michelle, a Great Dane breeder in Palm Beach Fl.
regarding the upcoming MSN ordinance.
They are under the gun back there and need help. I
have sent a number of emails with suggestions and
advice on how to attack their problem, which she says
have been helpful. As in a lot of these cases, the
county commissioners sound like they, or at least some
of them have already made up their minds. They have
been very secretive in responding to questions and to
my knowledge have not met with any of the anti-MSN
groups.

The dog groups back there have responded by writing
numerous letters and such, but I think all of us can
be helpful too. What I would ask is that everyone
email the county commissioners ASAP (Hearing is 1/15)
and ask them to not pass this MSN ordinance. The
reasons are all the same as AB 1634. What I see
happening in cities and counties is a tact of trying
to force us out of existence through exorbitant fees
and penalties. Pet owners have become the cash cow
for government.

The following is lengthy, but I would ask you to take
the time to read it and see to what extent local
politicians will sink. I also ask that you cross post
this email to every list you can. We need to act like
a brotherhood of dog and cat owners. If one of our own
is threatened, we all are threatened.

For those of you who have not had the opportunity to
read the newest Ordinance to be presented for its 1st
Reading on January 15, I have highlighted some of the
items that will affect anyone who breeds 2 litters or
19 puppies in a year. Specifically, Part 6. Chapter
4, Section 28 of the Palm Beach County Code entitled
Animal Care and Control Hearing Board is renumbered as
Section 30and Section 28, entitled Pet Overpopulation
Reform.

Any owners of unaltered animals (with a few
exceptions, police dogs, service animals, and dogs a
vet deems too unhealthy to spay/neuter) will be
required to pay $75/per animal and provide a certified
letter to Animal Care and Control either stating that
their animal is a show/competition animal or that they
promise not to breed their animal. Further in the
Ordinance though (Page 11, Lines 20-27), its states
that you will not be issued an unaltered license tag
until you sign "a written statement certifying that
the dog or cat will not be used for breeding or stud
purposes unless an appropriate permit is first
obtained from the Division."

All fees will apparently be determined at some later
date once this Ordinance has been passed. That should
be exciting since they have many planned. There will
be fees for license tags, late fees for failure to
timely renew, fines for failure to comply, application
fees, reapplication fee. It is doubtful that they
will ever end since we seem to be their new cash cow.

If you breed any puppies or kittens without the proper
permit, those puppies and kittens you just produced
(at great cost, I am sure) will now be given over to
Animal Care and Control.

You will be required to provide records all of the
litters produced and the vaccines given and any
medical conditions on those litters.

Quarterly you will be required to provide the name,
address and telephone number of new owners located in
Palm Beach County.

You will also be required to provide new owners with
your hobby breeder permit number so that they can have
proof and be assured that the puppy they just bought
from you was legally bred. It does not specify only
new owners in Palm Beach County so I guess that means
all new owners regardless of where they live.

Any change of ownership of any dog or cat must be
reported by the original and new owner within 30 days.
Again, it does not specifically identify these
individuals as having to be Palm Beach County
residents.

Must list hobby breeder permit number in all
advertisements. Advertisements is defined on Page 2,
Line 18-22 as "any statement made in connection with
the solicitation of an animal service, animal
business, and/or the sale of an animal and includes
without limitation, statements and representations
made in a newspaper or other publication, on the
radio, television, or Internet or contained in any
notice, handbill, business card, sign, catalog,
billboard, brochure, poster or letter." I guess our
Dog Show Catalogs will have a new look to them.

Must allow inspections of the structure or premises
where animals under the hobby breeder permit will be
kept. For most of us, that would be our home.

Each person owning an animal intended to be used for
breeding or studding shall obtain a hobby breeder
permit. I believe this mean husbands and wives would
each have to have their own permit as well any Palm
Beach County co-owners.

If your permit is revoked for any reason, you cannot
reapply for 1 year.

Violations of hobby breeder permit include:
· Failure to reapply for a permit within
thirty (30) days of expiration of an existing permit.
· Refusal to allow an animal control officer
to inspect an animal or the premises.
· Purposeful breeding of a dog or cat with a
known genetic fault.
