After having a puppy for a week, do you consider a new owner returning it because the puppy is "too rambunctious" justifiable reason for return?? One of our puppies went to his new home where the people have cats and he's running after the cats and slobbering on them. Having never been around cats I don't know how my dogs would react. Not like I keep one around to test drive or use as crash dummy for my puppies. Don't misunderstand my question-I have no problem taking the puppy back, in the circumstances he's better off back with me. My fear is they could be mean to him before I get him back. I say this because their voicemail message was "You need to come get this dog-he's too rough with my other animals and manhandles them" This is a 14 week old puppy-if they can't control him at 14 weeks he needs to come home as at that rate he'll rule the roost at 5-6 mths old. But do I hold their refund until I have the puppy vet checked for possible eye injury due to the cats batting at him? They want me to come get him, I delivered him 2 1/2 hrs from my home at no charge-just as a friendly gesture. My contract states new owners return the puppy to me. It also states replacement puppy.....do I replace a puppy for being returned for being a puppy? I've never had a puppy returned so really don't know what to think or do. Also the AKC paperwork was given to them filled out in their name-how do I change this with AKC and try to prepare the papers so he can be resold? Is the supplemental transfer form what I have this guy sign off on along with the origional dog registration? On a side note I would like to say this puppy in no way shape or form exhibited this behavior so I wonder if he is overstimulated and left to his own devices to do as he pleases. I want to do what is right but at the same time protect my interest. Sorry so LONG!!!!!!!!!!! Any suggestions appreciated.

I would go get the puppy and bring a police officer with you
then bring your contract. They are breaching the contract. Since it is alot of money to give them cash. You can go to the bank and get a cashier's check. Your account would not be on that the check. If you have the police with you, which you can, there is a fee for this, they can accompany you. and since these people breach the contract because you stated that you should be notified to have a chance to buy back the puppy before they can sell him, the cops can make him give back the puppy since you are willing to give back the money. I am a bought a bulldog once and the breeder wouldn't ship, and I can't pick him up due to my schedule, I offer to pay the breeder air fare to deliver to me. So consider this a lesson learned and stay away from people who are not willing to make the drive or pay you to deliver the puppy. I would not be able to sleep knowing what they do to the puppy. Do not bother to call them anymore, you will just alert them. Call the police and tell them you need this service and drive with the cop to their house and bring your puppy home.

I had just gone through this and threatened to go to small claims court. I said I was going to a lawyer and was having him draw up a letter to let them know what the consequences were going to be if they had not co-operated. They called and gave the puppy back before it ended up going any further. It only cost me $25.00 Best if luck. Its people like this that can ruin your life if you let them

Till you get the puppy back and in your arms. Hold all the money till puppy is checked by vet then honor your contract but I would NEVER give them another puppy. Good Luck.

Get the paperwork started at the small claims court and get them served ASAP. Let them know you are doing that and let them know they will have to pay all the court fees, vet bills, gas and what ever other expenses the whole situation is costing you and that they signed a legal contract that they are bound to. If they have any sense of reaosning they will return the puppy back but, you have to get them served so they know you are not messing around.
Do you have any friends who are lawyers?
Bring a lawyer with you who can explain what breach of contract is, and how unpleasant it can be....And bring that puppy home with you.

Once a buyer has purchsed a puppy and paid for him in full, then usually a contract stating that they will not rehome or sell him is only as good as the parties involved. If they have not already registered him, then you might have some recourse if you are still the owner on record. I am so sorry you are having to go through all this. I would definitely print out and keep all the emails between you. Good luck in getting your baby back, I know how difficult a time this must be for both of you. Do you think it would do any good to send them a reasonabole email outlining what you would be willing to do to get the puppy back? You might have to just go get him and give them back all their money at the same time. I would not make the exchange though until you had all the AKC paperwork back and a receipt for both the dog and the money. That may be the best you can get under the circumstances. I am so sorry you have had to go through this.

Where did you deliver the puppy to? What town I mean. If it is close to me anywhere I can maybe intervene for you if at all possible and try to get the puppy released to me. I am south of you, about 45-50 miles south of Atlanta.

If it were me, out of concern for the pup, I'd go and get him ASAP regardless of how far I had to drive, and then I'd give them cash if you didnt want to write them a check.
Write this off as a lesson learned with the sale of a pup, your contract, etc.
Bottom line, GO GET THE PUPPY!!!!!! If I lost every dime on him through this ordeal it would still be hundreds times better than watching the news about all the horrible things they did to him, etc. They've made it CRYSTAL clear that they don't want him.
If you need someone to go get him, I live in Delaware. I'd be happy to go get him so I know that he's safe and happy.

Then this puppy is in a really bad situation I would get in the car drive to where the puppy is and contact the local law enforcement and bring them w/you. I do not agree w/you saying if they sell him any home would be better than theirs I seriously doubt that if they are this irresponsible as a pet owner then you can bet they will dispose of the puppy any way that they can for $$$$.
This is why I only have had 1 litter these "people" will do and say anything and they absolutely have "no conscience".
Some thoughts....
First of all, I am so sorry that you have to go through this. Second, I am not a breeder so I don't have any insight from past experiences, etc. However, I have a few thoughts. They signed a contract, a contract is legally binding. Do you have a copy of it with their signatures? If you do, could you call the local police department for whatever town they live in and have them take the puppy? And/or you get in the car, drive there, call or stop at the police department when you get there and have them escort you? Have you been communicating with these people via e-mail? If so, print out all those e-mails where they state they will not give the puppy back to you and take those with you to the police department or fax them to the police department if they are able to get the puppy until you get there. If you are able to get the puppy back, I would say they were in breach of contract and don't deserve any money back. Or perhaps if you are feeling nice, give them half back. I just think if you have a contract that they have signed, they are legally bound to that contract. Again, I am so sorry you are going through this and I will be thinking about you and the puppy.

they wanted me to come get him
and they wanted their money back 100% regardless of what might be wrong with the dog & then refused to bring him back to me(I took him to them the least they can do is bring him back and my contract states the pup is to be returned to my home in event of return). I've tried to reason with them that I would send them a postal money order(I would never allow them at this point access to my checking acct#) but they now outright refuse to give him back and said any other home would be better than returning him to me. We are at a stalmate basically and not real sure where to go with this. I didn't keep my name on him since he was sold as a pet but contract states he can't be sold, transferred or given away without approval from breeder so they will be in breach of contract if he is rehomed. But we all know the contract is only as good as the people who honor it so I can only hope they will not be able to sell him and call me back. If they were to sell him I feel at this point any home would be better than theirs. I just hate my boy had to be dragged thru this. The bad side of breeding is the idiots we have to encounter and deal with. I was concerned for his welfare origionally but they have a cat and another dog that the bulldog was playing rough with and that's why they wanted to return him so they are animal lovers trying to protect their first pets so I have to hope that that is what will keep my poor boy safe. They also have to keep him healthy and safe if they even hope to rehome him. I want him back and at this point would go get him but the guy was ugly on the phone and when I told him the contract was legal and binding and he couldn't resell, rehome or transfer the dog he said you have to find him first. So it's gotten ugly. I've tossed all night trying to figure out how to get him back.

You can always give them another 'contract' stating that all money, minus gas and your vet bill (perhaps, depends on how nasty these folks are) will be returned in full after all paperwork is back and vet clears pup of any injuries etc. You can do a supplemental transfer I think to get the pup back in your name. I think you can request a duplicate registration if they have not sent it in to AKC yet I believe.
I'd be at their house by now...I wouldn't trust them with a hamster never mind a puppy...are there any other bully friends closer to them or someone from the board that you trust?
How sad but better now than later.

until you have the pup health checked and all the AKC paperwork signed and returned to you. When you have the pup back the way he was when he left, and the paperwork completed so he is yours again, then I would return the money. I would in no way give them another puppy at any time. JMO
as a breeder what i would do.....
1) hold 1/2 purchase price till all the ack paper work is in order
2) get a vet appt and have him checked over if their are any problems deduct that from the deposite
3) just go get the baby ....i also had it the dog had to be returned...but i always ended up going to get it i couldnt sleep...
4) chalk it up...things happenn just be glad they called you and didnt sell the puppy behind your back...
I don't have a problem giving the money back
I want the puppy back as they have proved unable to take care of him, I've just never had it happen before and don't know how to handle the paperwork with AKC. I also have to worry he comes home with eye injuries. Just basic questions since I've never had it happen before. Most people also call if they have problems, these people waited a week and called sounding like they were going off the deep end. I guess we meet all kinds unfortunately.

Give them their money back
Suggest another breed, Get your puppy and run,

Only withhold the refund if you are waiting on registration to be signed over
Get it over and done with as quickly as you can.
And in the future, never place a puppy with people who won't make the drive to get it, it's a basic test.
