I know many of you have contracts and such where you can reclaim your dog if abused, neglected ect...ect...
what would you do in a situation like this....?
the puppy has a disablilty...the family keeps emailing and calling you telling you that they have changed thier mind and cant keep the puppy because if its disability...(this happens over and over)
the pup was origionally sold as show prospect until the disability was found...so then the contract became void and money refunded down to less than pet price if they choose to keep the puppy..AKC registration was given back as well so ensure it was chancged to limited and the dog was neutered...
Each week the family has something happen that allows them to not keep the pup due to the safety of thier children...they call frantic and upset and says the pup has to be gone NOW...youy move heaven and earth to make arrnagements but when it comes down to it..they wont anser the phone calls or answer the door?
Can the dog be reclaimed or not?
Would the breeder have to come reclaim the dog or could someone else do it?

It is the responsibility of the breeder to take control of bad situations like this.
Most of the time it comes down to money. Offer them ALL of there money back!!
If they will not give the breeder the pup back and the breeder has offered them there money back, then they have taken the responsibility of ownership and should be willing to do what a responsible owner would do, treat the dog or if untreatable...put it down.
I would, and have, demanded that a pup be returned to me. The money is not worth the problems that will continue if you do not get your pup back. The breeder is the responsible party and should take charge of the situation. Get the puppy back and access its condition and go on from there.

I posted this info for a friend but will pass on everyones advice and private emails...
I think with each party being n a different state the situation is more difficult...and not much I can do since its not my pup..but i was willing to take the pup in as a resuce if the family could not handle it ....
so i had to hear both side of the story..
I guess at this point its not my problem and out of my control.all I can offer is assisance and help as a rescue volunteer in helpin them work with this dog and its problems...

once the pup was found to have a disabilty it voided the contract and a newone was writen up...from what i understand...I am a midle man on this bt not for long, LOL!
I would certainly be reclaiming the puppy back
in fact I would have done it long ago as soon as the disability appeared
